Chapter 7

The most common type of consumer bankrutpcy is Chapter 7.  A Debtor who files this type of bankruptcy is allowed to keep a certain amount of property in exchange for receiving an Order of Discharge of his debts.  The Debtor must list all of his assets and debts in his Petition for bankruptcy.  The process takes approximately 90 days and an appearance at what is called a Meeting of Creditors takes place about 30-45 days after filing.  There are certain requirements to qualify for Chapter 7, and an attorney should be consulted before filing.
